At EMD Serono Inc. (“EMD Serono”), safeguarding your privacy is a fundamental aspect of our commitment to you. This supplemental Consumer Health Data Privacy Policy is designed to provide transparency and clarity about our practices related to "Consumer Health Data" as defined by applicable laws, including Washington's My Health My Data Act, Nevada's Consumer Health Data Privacy Law, Connecticut's Data Privacy Act, and other U.S. health privacy laws, as amended and as and when they become effective including any regulations thereunder (“U.S. Health Privacy Laws”). Any term appearing in this Consumer Health Data Privacy Policy that has been defined under applicable U.S. Health Privacy laws shall have the meaning afforded to it therein. This Policy is effective as of June 30, 2024.

Categories of Consumer Health Data We Collect and How That Information Is Used

We collect, use, and disclose consumer health data only as necessary to provide you with the products or services that you request or with your explicit consent. This may include information related to:

Individual Health Conditions, Treatments, Diseases or Diagnosis: Information about your health history, symptoms, and/or treatment.

Use or purchase of prescribed medication: Information about medication that may have been prescribed to you and your use of such medication.

Bodily Function, Vital Signs, and Measurements related to health: Information about the operations of your body's systems, such as digestion, metabolism, immune support, or height and weight.

Reproductive and Sexual Health Information: Information about your reproductive system or sexual well-being collected when you voluntarily provide it to certain websites.

Biometric and Genetic Information: Information concerning your biometric and genetic characteristics.

Research Programs: Information you provide when participating in research studies or responding to our surveys, including any of the above categories about physical or mental health, medical history, or other health-related information.

For each of the categories of consumer health data collected, we may use and/or process your consumer health data for various processing purposes, including:

  • Consumer management, such as identifying and authenticating you to our different websites and mobile apps, administering and maintaining accounts and preferences, and helping you manage your website or app preferences.
  • Consumer service and communications, responding to your questions or requests for information, sending transactional messages, and other communications about our products or services, surveys, and invitations.

We collect consumer health data from various sources, including:

  • Directly from you, your caregivers, or agents, such as when you request certain health-related products and services.
  • From your interactions with us, such as when you visit our websites or use our health-related apps.
  • From third parties in connection with the services that we perform. 

Disclosures of Consumer Health Data

We do not sell your consumer health data. For each of the categories of consumer health data collected, we may share your consumer health data with our affiliates worldwide. We may also disclose it in the following circumstances:

  • With our data processors, service providers, and contractors who assist us in providing goods and services to you. These processors may only use the data as permitted by our contracts with them.

You have specific rights with respect to your consumer health data, including the right to:

  • Know if we are collecting, using, or disclosing your consumer health data, and to access that data, including receiving a list of the entities and affiliates with whom we have shared or sold your information.
  • Request that we delete your consumer health data.
  • Withdraw consent if we are processing your consumer health data with your consent.
  • Correct inaccuracies in your consumer health data.
  • Obtain a copy of your consumer health data processed by us.

Please note that EMD Serono does not control the acts of other non-affiliated entities, known as third parties. Third parties may collect your consumer health data over time and across different internet websites or online services that you use.
